Negligence in a malpractice context could be defined as: Failing to do what a reasonable and prudent nurse would do in the same or similar circumstance, or doing something that a reasonable and prudent nurse would not do.

 

Four Elements of a Malpractice Claim

1. The Nurse owes a duty to the patient (Lunsford case)

2. The Nurse breached the duty/ Failed to conform to the Standard of Care

3. The Patient suffered an actual injury

4. There was a causal connection between the Nurse's conduct and the injury

 

Standards of Care

For the judge to determine whether the care that was given was legally adequate, the standards of care of a profession are utilized. Standards of care are established through the state's Nurse Practice Act, a facilities policies and procedures and the ANA Standards of Practice

THE CASE:  

A 35-year-old female admitted to the 7blue Multi-Specialty Cardiac/Medical ICU for uncontrolled dilated cardiomyopathy with an EF 15% with B/P 180/100 (uncontrolled on max dose oral anti-hypertensive medication) who is also, 32 week (8 month) pregnant.  The patient is placed on DRIP, and initial fetal heart tone is normal via tracing.  During  the admission to the 7blue ICU, the primary RN is called by the patient stating, “I have a headache, and upper right abdominal pain”.  The primary RN titrates the patient’s B/P Drip and treats the patients’ pain with Fentanyl. During the patients stay the Intensivist and the L&D RN are at the patient’s bedside with concerns of ordered interventions for fetal care, which ultimately are the result of a fetal demise. Family has filled a legal claim against all responsible parties, Hospital, intensives, care teams.  At this time the standard of nursing care and experts are in question.
